GENERAL CONTRACTING CONDITIONS:

Users who make purchases on PUBLIMAG.ES, whether via the website, telephone, or email, accept these General Terms and Conditions in their entirety and are bound by them as stated at the time of purchase. Users are required to read and accept these Terms and Conditions prior to purchasing any product.

PUBLIMAG.ES reserves the right to modify the General Terms and Conditions at any time and without prior notice. They will always be accessible through the website, so that the user can consult or print them at any time.

Prices and terms of sale are for informational purposes only and may be modified based on market fluctuations. However, placing an order by completing the purchase form implies acceptance of the price offered and the general terms and conditions of sale in effect at that specific time. Once the order is placed, the purchase will be deemed to be fully completed, with all legal guarantees protecting the purchasing consumer. From that moment on, the prices and terms will be contractual and may not be modified without the express agreement of both parties. The contract will be formalized in Spanish. The electronic document formalizing the contract will be archived.

PUBLIMAG.ES reserves the right to deny and/or suspend access to the services provided on the website due to breaches of good faith, non-compliance with applicable legislation, non-compliance with these General Conditions of Purchase, and/or in cases of fraud detected by this company and/or any of its suppliers.


SHIPPING:

Customers can choose the delivery day and time slot from the options offered by our courier partners. We cannot guarantee these delivery times as we rely on a third party, but we try to ensure that courier companies meet them whenever possible.

It's not possible to choose a specific time within a specific time slot. If you leave us a specific request, we'll forward it to the courier and do everything possible to fulfill it, but we can't guarantee it, as it's not part of the contracted service.

Delivery times depend on the availability of each product, which is indicated for each product offered. If a product is unavailable or its delivery time exceeds the date selected by the customer, the customer will be contacted to process the order. If the customer cannot be reached, the company will always safeguard the customer's interests.

The customer will have 24 hours to verify the integrity of all components of the order and to ensure that everything required is included in the included products. After this 24-hour period, the shipment will be deemed accepted, and claims for defects or shipping errors will not be accepted.

Delivery of the shipment will be made to the address indicated as the destination. Delivery will be deemed complete when the competent person present at that address agrees to collect the shipment, whether or not the recipient listed on the delivery note is the recipient.

If you receive a product damaged in transit, we recommend contacting us within 24 hours, providing as many photos as possible showing the damage, so we can file a complaint with the shipping company. If the package has any visual damage, please indicate this on the delivery note.

We only deliver Monday through Friday. It is the customer's responsibility to determine whether the selected delivery day is a weekday or a holiday in the destination location. If a holiday occurs, we will notify the customer as soon as possible to advance or delay delivery. Therefore, under no circumstances will PUBLIMAG.ES be liable for any damages caused by selecting delivery on a local holiday.

Shipping costs will be calculated dynamically based on the location, type of service, and day selected. In any case, the customer will be clearly informed during the purchasing process and always before the payment gateway.


WITHDRAWAL:

PUBLIMAG.ES informs you that the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options for exercising the right of withdrawal. These include the possibility of doing so online, an option we recommend in order to reduce processing time and provide the customer with the most convenient option. To do so, please send an email to info@publimag.es with the subject: WITHDRAWAL.

In accordance with current legislation, the contract may be terminated without providing any justification and without any penalty within 14 calendar days of the customer receiving the merchandise. To do so, once you notify us of your decision to exercise your right of withdrawal, you must send us the product(s). Once we receive the product(s), we will refund you according to the payment method you used:

– If you paid by card, we'll credit your account, usually within 48 to 72 hours. It may take up to ten business days for the credit to appear in your account, depending on the payment gateway used.
– If you paid via PayPal, we'll refund your PayPal account. This usually takes place within 48 to 72 hours.
– If you paid by bank transfer, we will ask for your account number to process the refund. Most payments will be processed within 48 to 72 hours, but please note that it may take up to 48 business hours for the refund to appear in your bank account. – In any case, please note that the legally mandated refund period is 14 calendar days. We will always try to refund your money as soon as possible, but for administrative reasons, the refund period may be extended to 14 calendar days. We apologize in advance and appreciate your understanding.

The right of withdrawal will not apply to contracts that refer to:

– The supply of goods made according to the consumer and user's specifications or clearly personalized.
– The supply of goods that may deteriorate or expire quickly.
– The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.

In addition, it should be noted that:

– The product must arrive at our facilities in the same condition as it was delivered. If it does not retain its packaging, accessories, and original condition, we will not accept the request.
– Return shipping is the customer's responsibility and must be sent using the same protective box in which it was received. If this is unavailable, the customer must return the item in similar protective packaging so that it arrives at our facilities in perfect condition.


RETURNS:


RETURNS FOR INDIVIDUALS:

All merchandise must be returned in its original packaging and condition, in perfect condition and protected, avoiding stickers, seals, or adhesive tape directly on the surface or packaging of the item. Otherwise, PUBLIMAG.ES reserves the right to reject the return.

Once your return request has been accepted, you will receive instructions on how to return the product to our offices. You must return the goods without delay, within a maximum of 14 calendar days from when you notify us of your wish to exercise this right.

Return shipping costs will be your responsibility. You are free to choose and find the agency that best suits your needs or offers the most competitive rates. You can also come to our facilities to drop off the product.

Once we receive the merchandise and verify that it's in perfect condition, your refund will be processed. We'll refund your payment, excluding shipping costs.


RETURNS OF CUSTOM PRODUCTS:

Since many of the products on PUBLIMAG.ES are personalized, we would like to dedicate a specific section of our General Terms and Conditions to this type of item. In compliance with Article 45 of Law 7/1996 of January 15 on Retail Trade, there is no right of return for goods manufactured according to the customer's specifications or that have been clearly made to measure. There is also no right of return in the event of damage due to misuse.

Returns resulting from an error caused by PUBLIMAG.ES or a product defect are excluded from this jurisdiction. In such cases, PUBLIMAG.ES undertakes to exchange the defective product for an identical one as quickly as possible. It will also cover the return and shipping costs. If the exchange cannot be made, the amount will be refunded.

In the event of a defective product due to poor management by PUBLIMAG.ES, we will proceed, as appropriate, to repair, replace, reduce the price, or terminate the contract. These actions will be free of charge for the consumer and user.

If the exchange is due to an error in the choice of size or color, or in any of the product options, and the buyer is responsible for this error, PUBLIMAG.ES will not accept the return.

Occasionally, the shipping company returns undelivered orders to our facilities because the recipient is absent from the postal address indicated on the package, or the postal address is incorrect, and we have been unable to contact them by any means. In these cases, our company notifies the user of this incident and processes a new shipment with the correct postal address confirmed, which will be the customer's responsibility. If the user does not respond to our notifications, we retain the package at our facilities for up to six months. After this period, the package is destroyed.

For some orders, the purchased product may be shipped inside a case, box, or packaging specifically tailored to the product. This case or packaging is provided for better protection and presentation of the product, but is not included in the product price. Therefore, if it arrives broken or damaged, it cannot be replaced, replaced, or refunded. Only the customized product itself is covered for replacement or return if it meets the necessary conditions (printing or manufacturing errors, etc.).

Customized products are made with the image and/or text submitted by the user, in the same position, quality, resolution, and dimensions. The user is responsible for ensuring that the image or text submitted when placing the order meets the appropriate requirements for proper manufacturing. PUBLIMAG.ES will not assume any liability for color or resolution differences between the original image and the supplied product caused by poor quality of the original image file. Claims based on aesthetic taste will not be justified as grounds for any refund.


CANCELLATIONS

Customers may request cancellation of an order if it has not been customized and in any case, no more than 24 hours have passed since the order was created. If the cancellation period has passed or the product has been customized, the cancellation request will be considered a withdrawal and must comply with the provisions for that case.

In the case of products made to the consumer's specifications or clearly personalized, cancellations will not be accepted if they have already been manufactured, even if they have not been shipped.


COMMITMENT PAYMENT BY CARD

This merchant agrees not to allow any transaction that is illegal, or that is considered by the credit card brands or the acquiring bank to be illegal, or that could or has the potential to damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards.

In addition, the following activities are also explicitly prohibited:

ADMISSION POLICY

PUBLIMAG.ES reserves the right to reject or cancel orders whose text or images contain insulting, discriminatory, or violent content that may harm children's rights or that may damage its image. An order that meets any of these criteria may be canceled even after the buyer receives the confirmation email.

If this occurs, PUBLIMAG.ES will notify the buyer of the cancellation of their order and/or issue a full refund.


TERMS OF USE

All content on PUBLIMAG.ES (from text to photographs, including logos, designs, buttons, files, web code, etc.) is protected by intellectual and industrial property laws. Reproduction of this content in whole or in part without the express written authorization of PUBLIMAG.ES is prohibited.

PUBLIMAG.ES cannot guarantee that there will be no interruptions or errors in accessing the website, although it will endeavor to prevent this and will use all available means.

The customer freely and voluntarily accesses PUBLIMAG.ES, and the company is therefore not responsible for any consequences, damages, or losses that may arise from such access.


INTELLECTUAL PROPERTY RIGHTS

The user is responsible for the content of the images submitted for the creation of personalized gifts and guarantees that they are the sole owner of all rights to the images submitted. Furthermore, the user guarantees that they will not infringe upon the rights of third parties regarding the persons or objects depicted in the photos.


WARRANTIES

Generally, the warranty period is one year from the date of purchase. For this, it is essential to have the purchase receipt, which will serve as proof that the product was purchased at a store and will show the date of purchase. In the case of PUBLIMAG.ES, the email with the purchase confirmation.

The warranty does not cover defects caused by improper use of the product and/or manipulation other than that necessary to establish its nature, characteristics, or operation. In these cases, the consumer must be responsible for repair. Therefore, the following are excluded from the warranty:

– Defects and damage caused by external factors, accidents, wear and tear, and use not in accordance with PUBLIMAG.ES' instructions.
– Products modified or repaired by the customer or any other person not authorized by PUBLIMAG.ES, as well as products covered by a specific support contract.
